Terms of Service

1. Acceptance of Terms

By accessing or using NOVAM ("the Service") at novam.us or Novam Studio at studio.novam.us, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

NOVAM is an AI integration platform that helps businesses identify and deploy AI solutions. The Service includes an AI intake tool that analyzes your business situation and recommends tailored solutions, as well as a self-serve AI agent builder that allows you to deploy AI agents for customer support, lead qualification, appointment booking, and other use cases. The Service also includes Novam Studio, a content creation and publishing app for creating, editing, scheduling, and publishing content to social media accounts you connect.

3. Account Registration

Certain features of the Service require account registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when registering.

4. Use of AI Features

The Service uses artificial intelligence to analyze business descriptions, generate solution recommendations, and power AI agents. You are solely responsible for reviewing any AI-generated output before acting on it or making it available to your customers. NOVAM makes no guarantees regarding the accuracy, completeness, or suitability of AI-generated content or recommendations.

5. User Content

You retain ownership of all content you provide to the Service, including business descriptions, knowledge base content, and agent configurations. By submitting content, you grant NOVAM a limited license to process and use that content solely to provide the Service, except that AI intake inputs may be used in anonymized form to improve our classification models. We do not use your content for any other purpose.

6. Prohibited Use

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Prohibited uses include but are not limited to: submitting false or misleading information, attempting to circumvent security measures, using the Service to harass or harm others, or violating any applicable law or regulation.

7. AI Agent Deployment

When you deploy an AI agent through the Service, you are responsible for its configuration, the accuracy of the knowledge base you provide, and how it interacts with your customers. NOVAM is not liable for the actions or outputs of agents you deploy. You must ensure your use of deployed agents complies with applicable laws, including consumer protection and disclosure requirements.

8. Novam Studio and Connected Accounts

Novam Studio connects to third-party platforms, including YouTube, Instagram, Facebook, TikTok, X (Twitter), and LinkedIn, through their official APIs. When you connect an account, you authorize the Service to act on that account only as needed to provide the features you use, such as publishing the content you schedule. You are responsible for the content you publish, including having the rights to any video, music, or images you upload, and for following each platform's own terms and community guidelines. You also agree to the terms of each connected platform (including Meta, TikTok, X, and LinkedIn).

By connecting a YouTube channel, you agree to be bound by the YouTube Terms of Service. Novam Studio uses YouTube API Services, and Google's handling of your data is described in the Google Privacy Policy. How we handle data from connected accounts is described in our Privacy Policy.

Third-party platforms may change or limit their APIs at any time. NOVAM is not responsible for posts that fail, are delayed, or are removed because of a platform's actions, outages, or policy changes. You can disconnect any account at any time from the Accounts page in Novam Studio.

9. Payments and Billing

Certain features of the Service are offered on a paid basis. All fees are stated at the time of purchase. Payments are processed by third-party payment processors. Subscription fees are billed on a recurring basis and may be cancelled at any time. Refunds are handled on a case-by-case basis — contact us at hello@novam.us.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violations of these Terms. You may terminate your account at any time by contacting us at hello@novam.us.

11. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free operation of the Service. AI recommendations and outputs are for informational purposes and do not constitute professional advice.

12. Limitation of Liability

To the fullest extent permitted by law, NOVAM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
